Lawyers, public chant "hang him" as Bangladesh building owner led to court

DHAKA (Reuters) - Bangladeshi lawyers and protesters chanted "hang him, hang him" on Monday as the owner of a factory building that collapsed last week killing nearly 400 people was led into court dressed in a helmet and bullet-proof jacket, witnesses said.
The drama came as rescue officials said they were unlikely to find more survivors in the rubble of the building that collapsed on Wednesday, burying hundreds of garment workers in the country's worst industrial accident.
Heavy cranes were being used to lift huge concrete blocks from the wreckage of Rana Plaza, where 385 people are now confirmed to have been killed. The building housed factories making clothes for Western brands.
Eight people have been arrested - four factory bosses, two engineers, building owner Mohammed Sohel Rana and his father, Abdul Khalek. Police are looking for a fifth factory boss, David Mayor, who they said was a Spanish citizen.
Rana, a local leader of the ruling Awami League's youth front, was shown on television being brought to Dhaka in handcuffs after he was seized in the border town of Benapole by the elite Rapid Action Battalion following a four-day manhunt.
Rana was arrested by police commandos on Sunday, apparently trying to flee to India.
"Put the killer on the gallows, he is not worth of any mercy or lenient penalty," one onlooker outside the court shouted.
The court ordered that Rana be held for 15 days "on remand" for interrogation.
Khalek, who officials said was named in documents as a legal owner of the building, was arrested in Dhaka on Monday. Those being held face charges of faulty construction and causing unlawful death.
Bangladesh does carry out the death penalty for murder and for most serious categories of manslaughter.
Hundreds of the mostly female workers who are thought to have been inside the building when it caved in remain unaccounted for. A fire overnight further hampered the last desperate efforts to find survivors.
"We are giving the highest priority to saving people, but there is little hope of finding anyone alive," army spokesman Shahinul Islam told reporters at the site.
About 2,500 people have been rescued from the wrecked building in the commercial suburb of Savar, about 30 km (20 miles) from the capital, Dhaka.
Late on Sunday, sparks from rescuers' cutting equipment started a fire in the debris as they raced to save a woman who may have been the last survivor in the rubble. Her body was recovered on Monday afternoon.
"We could not save her, even though we heard her voice this morning," a tearful rescue worker told reporters at the scene.
Officials said the eight-storey complex had been built on swampy ground without the correct permits, and more than 3,000 workers - most of them young women - entered the building on Wednesday morning despite warnings that it was structurally unsafe.
A bank and shops in the same building closed after a jolt was felt and cracks were noticed on some pillars on Tuesday.
The collapse was the third major industrial incident in five months in Bangladesh, the second-largest exporter of garments in the world behind China. In November, a fire at the Tazreen Fashion factory in a suburb of Dhaka killed 112 people.
Such incidents have raised serious questions about worker safety and low wages in the poor South Asian country, which relies on garments for 80 percent of its exports. The industry employs about 3.6 million people, most of them women, some of whom earn as little as $38 a month.
In a development that may raise questions about the authorities' handling of the rescue operation, a spokesman at the British High Commission on Monday confirmed that an offer of technical assistance from Britain had been declined.
Anger over the disaster has sparked days of protests and clashes, and paramilitary troops were deployed in the industrial hub of Gazipur as garment workers took to the streets again on Monday, smashing cars and setting fire to an ambulance.
The unrest forced authorities to shut down many factories, which had reopened on Monday after two days of closures. Police fired teargas to disperse protesters.
The main opposition has called for a national strike on May 2 in protest over the incident.
Emdadul Islam, chief engineer of the state-run Capital Development Authority, said last week that Rana had not received the proper construction consent for the building, and had illegally added three stories to the original five.

Automatic spending cuts nix $90m in college aid
WASHINGTON (AP) ? Schools near military bases and tribal lands will face a $60 million shortfall between now and September and aid to college students will be cut by almost $90 million, according to the Education Department's plan to carry out the automatic spending cuts mandated by Congress.
In all, the Education Department lost $2.6 billion as part of failed budget negotiations that forced deep spending cuts to reduce the nation's debt. Every corner of the federal government has been slashing services to comply.
"Budgets are never just numbers. They reveal our values. They reveal our value choices," Education Secretary Arne Duncan told reporters on Monday at an event to discuss prekindergarten programs. "You do not see our high-performing competitors defunding education and innovation via sequestration. Other nations, our international competitors, they keep their eye on the prize and they don't let dysfunctional politics create a man-made mess."
Taken as a whole, the cuts could force fast changes at the end of the school year.
For instance, areas where large portions of land are owned or managed by the government, such as military or tribal areas, receive more than $1 billion in federal aid annually to make up for the lack of land subject to property tax. Under the automatic budget cuts, that sum is being slashed about 5 percent.
Students who work in college libraries, dining halls or elsewhere on campus will see a collective $51 million in work study aid cut. Separately, grants for needy students will be cut $38 million. Some $1.6 billion in college aid will remain, however.
Most of the Education Department's cuts will translate to fewer dollars to pay salaries at the state and local levels. For instance, the department's plan cuts $20 million from a program designed to help students who move between states or countries during the school year catch up. Often, those students are children of migrant farmers who require additional help to get on the same page as their classmates.
Separately, programs to help students learn English were slashed by $38 million.
As implemented, the spending plan also will cut $28 million from the administration's "Race to the Top" competition that rewards states for implementing changes in how schools teach and students learn. Some $520 million, however, remains in that pot for states to try new approaches to boost student performance.
An additional $13 million for charter schools and $5 million for magnet schools were expected to be cut, according to the budget outline.
And the budget cuts would reduce student counseling services, school safety and community development efforts by $13 million.
Across all agencies and departments, the reductions total $1.2 trillion over 10 years. The first-year cuts are $85 billion but many programs are exempt from the cuts such as Social Security and Pell grants.

Belcher's career went on hiatus in 2010 and 2011 when he had to undergo emergency eye surgery to save his vision. The sight of a doctor checking out Belcher's vision was worrisome. Luckily, he just needed stitches on his eyelid.

Bisping beat Belcher on Saturday, but is facing some medical issues of his own. He is suffering from nerve damage that requires surgery.
"I have stenosis, which is a trapped nerve that causes atrophy and numbness in my right arm,? Bisping said on Fuel TV after his fight at UFC 159. ?It?s progressively getting worse and worse. I saw a surgeon about six weeks before this fight and they told me I needed surgery (but) there was no way I was going to pull out of this fight.?
He said that he will head home and sort everything out when he decides his next steps are.

Samsung Galaxy Tab 3: Yet Another Boring New Android Slate
Just in case you thought Samsung didn't offer enough variety in its tablet range, its gone ahead and launched yet another. This 7-inch Galaxy Tab 3 is brand new and, um, like virtually every other Samsung tablet that's gone before it.
The third iteration of Samsung's first tablet attempt, this little seven-incher packs a 1.2GHz processor, 8GB or 16GB of storage, 3-megapixel rear camera, 1.3-megapixel front facer, and Android 4.1. A fairly bland spec list to accompany what is quite a bland product.
The Wi-Fi version of the Tab 3 will roll out across the world in May, with a 3G model following in June. There's currently no word on pricing, but it will probably be comparable to the existing Tab 2. Not that you'd notice the difference. [Samsung via Engadget]

Obama jokes about aging during second term
WASHINGTON (AP) ? President Barack Obama joked Saturday that the years are catching up to him and he's not "the strapping young Muslim socialist" he used to be.
Obama poked fun at himself as well as some of his political adversaries during the annual White House Correspondents' Association dinner attended by politicians, members of the media and Hollywood celebrities.
Entering to the rap track "All I Do Is Win" by DJ Khaled, Obama joked about how re-election would allow him to unleash a radical agenda. But then he showed a picture of himself golfing on a mock magazine cover of "Senior Leisure."
"I'm not the strapping young Muslim Socialist that I used to be," the president remarked, and then recounted his recent 2-for-22 basketball shooting performance at the White House Easter Egg hunt.
But Obama's most dramatic shift for the next four years appeared to be aesthetic. He presented a montage of shots featuring him with bangs similar to those sometimes sported by his wife.
"So we borrowed one of Michelle's tricks," Obama said. "I thought this looked pretty good, but no bounce."
Obama closed by noting the nation's recent tragedies in Massachusetts and Texas, praising Americans of all stripes from first responders to local journalists for serving the public good.
Saturday night's banquet not far from the White House attracted the usual assortment of stars from Hollywood and beyond. Actors Kevin Spacey, Julia Louis-Dreyfus and Claire Danes, who play government characters on series, were among the attendees, as was Korean entertainer Psy. Several Cabinet members, governors and members of Congress were present.
And despite coming at a somber time, nearly two weeks after the deadly Boston Marathon bombing and 10 days after a devastating fertilizer plant explosion in West, Texas, the president and political allies and rivals alike took the opportunity to enjoy some humor. Late-night talk-show host Conan O'Brien headlined the event.
Some of Obama's jokes came at his Republican rivals' expense. He asked that the GOP's minority outreach begin with him as a "trial run" and said he'd take his recent charm offensive with Republicans on the road, including events with conservatives such as Sen. Ted Cruz, Sen. Rand Paul and Rep. Michele Bachmann.
"In fact, I'm taking my charm offensive on the road -- a Texas barbeque with Ted Cruz, a Kentucky bluegrass concert with Rand Paul, and a book-burning with Michele Bachmann," Obama joked.
Casino magnate Sheldon Adelson would have had better success getting Obama out of office if he simply offered the president $100 million to drop out of last year's race, Obama quipped.
And on the 2016 election, the president noted in self-referential irony that potential Republican candidate Sen. Marco Rubio wasn't qualified because he hasn't even served a full term in the Senate. Obama served less than four years of his six-year Senate term before he was elected president in 2008.
"I mean, the guy has not even finished a single term in the Senate and he thinks he's ready to be President," Obama joked.
The gala also was an opportunity for six journalists, including Associated Press White House Correspondent Julie Pace, to be honored for their coverage of the presidency and national issues.
The New Yorker's Ryan Lizza won the Aldo Beckman Award, which recognizes excellence in the coverage of the presidency.
Pace won the Merriman Smith Award for a print journalist for coverage on deadline.
ABC's Terry Moran was the winner of the broadcast Merriman Smith Award for deadline reporting.
Reporters Jim Morris, Chris Hamby and Ronnie Greene of the Center for Public Integrity won the Edgar A. Poe Award for coverage of issues of national significance.

News Summary: EPA lowers methane leak estimate
PITTSBURGH (AP) -- THE CHANGE: The U.S. Environmental Protection Agency recently dramatically lowered its estimates of how much of a potent greenhouse gas leaks during gas drilling operations, from 214 million metric tons for 2010 to 144 million metric tons, a change of more than 30 percent.
THE DISPUTE: There's a split between leading environmental groups over whether the boom in natural gas drilling, or fracking, will help or hurt efforts to fight climate change. That's because while natural gas is a far cleaner burning fuel than coal, the methane in the gas is also a potent greenhouse gas. If too much methane leaks into the atmosphere, that negates the benefits over coal.
THE REACTION: Environmentalist Michael Shellenberger said the EPA revisions are "great news" and "kind of an earthquake." But 350.org founder Bill McKibben said the news doesn't change the fact that natural gas is still a fossil fuel that emits some greenhouse gas.

The time of simple communication is dwindling toward extinction. Think about it: When?s the last time you called a friend from a landline phone and talked for hours? Year after year, study after study, it?s shown that teens favor communicating through social networks such as Facebook and Twitter.
But now, there?s a new crop of social networking applications that are readily available to teens (aka free)?and there?s something for everyone. Want to show off a vacation photo? Instagram is your best bet. Interested in documenting your life, one check-in at a time? Path can help you with that. Or maybe you just want to send a silly selfie to your best friends? Check out Snapchat.
We rounded up some of the most popular communication apps, tried them out for ourselves and gave them report cards.
Instagram
Instagram allows its users to play professional photographer with filters, a cropping tool and focus options. Plus, you can see what your friends (and celebs) are up to through live updates.
Unlike Facebook and Twitter, Instagram is a photo-only app that banks on creativity. ?People love it because it shows a little bit of your personality and your life,? said Brianna Booth, a freshman at Barrington.
Since Instagram?s launch in 2010, heaps of knockoff apps have debuted. Still, most lack the massive following that Instagram has built.
Instagram did come under fire late last year after changing its terms of service. Users worried that the app could sell their works of art. Instagram cleared that up: You own your photos, but Instagram can share your user data with its parent company, Facebook.

GifBoom
In a nutshell, GifBoom is a moving Instagram. The app makes it easy to create and share your very own gifs (aka animated photographs, like the ones on whatshouldwecallme.tumblr.com). Unlike Tumblr, GifBoom only allows its users to share gifs?no still photos allowed.
One major complaint? It?s not super user-friendly at first. ?It was hard to navigate for the first week,? said Gina Paletta, a freshman at St. Charles East. ?I had no idea what I was doing and it took time to figure out.?
Once you get the hang of it, GifBoom is a unique app to have. If you?ve ever wished your Instagram photos could move, this app is for you.

Pheed
If Facebook, Twitter, Instagram and YouTube had a baby (don?t ask us how), it would be Pheed. The easy-to-use, clutter-free app is quickly gaining popularity and followers. You can use Pheed to share texts, photos, videos, audio and live broadcasts.
Some would say the concept is new, but others find it repetitive. ?Facebook is all I need because other apps are basically all just the same,? said Jose Garcia, a junior at Carl Schurz.
But there is something that sets Pheed apart: Users can subscribe to premium channels for a fee (anywhere from $1.99 to $34.99 per month). For example, a singer might broadcast their performance or concert on Pheed and users would have to subscribe?and possibly pay a fee?to view it.

If you love the idea of Facebook?s timeline, Path might just be your new favorite app. The new-ish concept allows you to share almost anything: your current location, what you?re listening to, future plans, cute stickers and more. The app also allows you to have conversations with friends (as shown above).
?Facebook and Instagram are easier to use and understand, but Path is a more minute-by-minute timeline of someone?s day,? said Brooke Rinker, a senior at St. Charles East.
One major difference between Facebook and Path is that you can have only 150 friends on Path. It creates a more close-knit feeling for many users, but some find it too restrictive.

Snapchat
Snapchat is like nothing else on the app market. You take a photo or short video, add text or a doodle and send it to your friends to view for a set amount of time (one to 10 seconds, your choice). Once your friends open the pic, they have to press down on their phone screen to view your photo. After the timer is up, the photo or video disappears forever ? or so we?re told.
?Snapchat allows people to easily share information about their lives on a whole (different) level using photos,? said Willie Stevan, a sophomore at Whitney Young. ?I send about 15 snaps a day and receive, like, 50!?
One downfall? The privacy settings are questionable. A University of Michigan student and hacker, Raj Vir, reported that users secretly can save incoming images. Note to all: Don?t send anything via Snapchat that you wouldn?t want to resurface.

Officials: 19 killed in car bombings in south Iraq
BAGHDAD (AP) ? Three car bombs exploded Monday in public areas in two cities in Iraq's largely calm Shiite Muslim south, killing 19 civilians and wounding dozens, officials said.
The attacks come amid a week-long spike in sectarian violence following clashes at a Sunni protest camp in the north of the country.
Two parked car bombs went off simultaneously Monday morning in the city of Amarah near a gathering of construction workers and a market, killing 12 civilians and wounding 25, according to police. Amarah is located 320 kilometers (200 miles) southeast of Baghdad.
Another police officer said a parked car bomb exploded near a restaurant in the city of Diwaniyah, killing seven civilians and wounding 15 others. The city is located 130 kilometers (80 miles) south of Baghdad.
Two medical officials confirmed the casualty figures. All officials spoke on condition of anonymity as they were not authorized to release information.
Sectarian violence has spiked since Tuesday, when security forces tried to make arrests at a Sunni Muslim protest camp in the northern city of Hawija. The move set off a clash that killed 23 people, including three soldiers.
The Hawija incident and a spate of follow-up battles between gunmen and security forces as well as other attacks, including Monday's, have left around 200 dead in the last week.
Bomb attacks are relatively rare in Iraq's relatively peaceful southern Shiite cities.
No one has claimed responsibility for Monday's attacks, but coordinated bombings in civilian areas are a favorite strategy used by al-Qaida in Iraq.

'Known Lesbian' Reaches Out to Cardinal Without LGBT Friends ...
In mid-April,?Bondings 2.0 reported on a South African cardinal who claimed to know of no LGBT individuals personally, and thus rejected any claims he could be homophobic. Now, a self-ascribed ?known lesbian? has written to Cardinal Wilfrid Fox Napier to challenge his statements, and, in between, presents a novel argument for why Catholic prelates fight so?fiercely?to deny LGBT equality.
Melanie Judge?s piece was published in the?Mail & Guardian, a leading African paper, under the title, ?Hi, Cardinal Napier. I?m lesbian.? She begins by questioning the cardinal?s involvement on issues of sexuality if he knows of no LGBT individuals:
?For someone who doesn?t know any homosexuals, you?ve spent a considerable amount of time concerning yourself with the lives of lesbian and gay people ? specifically our rights to equality and protection under the law.
?If you don?t know us, and then by implication there aren?t any of us in your church, it seems queer that you would assume such an active position in denying us our right to rights.?
Ms. Judge is not content to say that Napier is simply anti-gay. ? Instead, she believes his staunch opposition to South African legislation that would legalize civil unions is merely an attempt to preserve his power, and the power of the Catholic Church, that
??entrenches a version of social relations and human sexuality based on male supremacy, the subordination of women, and the abjection of homosexuality?.Perhaps your investment in the lives of sinful others is driven by an interest in protecting that power and the ideology that props it up. If so, I can understand why you?d rail against gays, lesbians and women who challenge your ideology.?
She continues by shedding light on Napier?s attempt to make LGBT people invisible, which contradicts the Church?s call to acknowledge, welcome, and include LGBT people:
?As you would know, a powerful way to neutralise nonconforming people whose very existence challenges your church?s prescription for human interaction is to make them invisible. To deny the very existence of gay and lesbian people is to render them unknowable and unseeable. Excluding people in this way sends a message to lesbian and gay people in your church (many of whom I know and see, and I?m not even Catholic) that they will be not be acknowledged by your leadership. To deny recognition is to deny human dignity, a strategy at the heart of homophobia.?
Ms. Judge?s comments examine the desperate attempts by Catholic bishops to maintain their privilege in a society structured around heterosexual relationships and male dominance, adding the unique perspective of a South African to her critique of oppression:
?Sexuality and gender were heavily regulated and constrained under apartheid and colonialism. Women and queers ?knew their place? and ?suffered? quietly and invisibly. Now we see a burgeoning of sexual and gender diversity ? it?s exciting stuff, Cardinal. It?s a sign of a plural and democratising society in which ?difference is no longer synonymous with dysfunction.
?Shunning difference and enforcing conformity is how the church has asserted its control over populations for centuries. But this unchecked grip on power has been slipping in the face of democratic pressures. I feel for you, Cardinal; it?s hard to compete with the divine prospect of freedom and equality?
?Queers and women are laying claim to the resources, recognition and representations of citizenship ? both inside and outside the church. It?s the stuff of democracy and of human rights. Still, none so blind as those who will not see.?

So??I?ve arrived. Day 3 of being at the tower. Good thing they brought in a snow plow to clear the paths to the outhouse, storage sheds, and cabin. It would have been days of?shoveling. Day 1 of the fire season and I?m starting with a base of 36 cm of snow!
And guess what??It?s still snowing. I?ve been in a snow cloud now for a solid 24 hours and there doesn?t seem to be an end in sight. That?s not a bad thing necessarily. It?s giving me lots of time to ?settle? in. Unpack boxes and suitcases. Trying to find things, like where do they keep?batteries, the broom, and mop? This place has been shut up since last October so there?s a bit of cleaning to do. And I have nothing but time.
Lots and lots of time. Especially since the Internet (using an Aircard), isn?t nearly as good as I had hoped for. It doesn?t look like I?ll get as much use out of it as I had planned, except for the necessities (incredibly long loading times), like blog posts. That makes me a little sad. But I am in the middle of nowhere and should be grateful, after all, to have it in the first place. So, no more complaining from me.
I returned to the same tower I was at 4 and 5 years ago. What are the chances?
There are some good memories here and I keep finding evidence of my story, here and there. Antique salt and pepper shakers I brought with me the first year that I?d forgotten about. Small delicate glass shakers. So out of place in this rugged isolated place. A beautiful scented candle my best friend gave me years ago for my birthday (mostly used up, but with a little life left in it yet). The scent is Mediterranean Fig. An old apple basket I used to keep my onions and garlic in. Oh! And best of all, the tackiest clock you ever did see. Dusty blue in color, with a floral brocade background. Hideous, yet still hanging in the exact same spot. There?s a fondness for that hideous thing, for some reason or another.
This is an old cabin with plenty of character. Probably built in the 1970s, judging by the cupboards, wood paneling and the state of the floor. I better get my nostalgia in while I can. This ol? cabin is being ripped out next year and being replaced with a newer, ?better? version. I say ?better? since the new cabins are supposed to have very little storage in the kitchen and the bedroom closet has been replaced with an indoor shower. The shower sounds promising doesn?t it? Don?t get too excited, there?s still no running water, but it does provide a good place for a shower bag and protection from the bugs (priceless!). However, for a girl who loves food, cooking, and clothes, cupboard space and a closet are just as essential. I guess we?ll just have to wait and see.
As for the whole vegan thing, after three days, I feel a little hungry. I won?t lie.
If you?re wondering about a meat lover going vegan, I go into detail about it in?this post. But essentially I?m still a meat eater so if anyone wants to come by with some hunted meat or farm fresh eggs, I?m in. But finding sustainably raised meat around here would be next to impossible unless you were in tight with the locals. So I?m putting my values to the test. Can I do it? Probably, if I can figure the hunger part out.
On Day 1, I just unpacked. On Day 2, I made some soft vegan ?cheese? made of soaked cashews. Something I?ve been meaning to try. Wish I had done it earlier. Boy was I missing out. I actually have to refrain myself from eating it by the spoonful. I?ve also made some sprouted spelt and sesame bread and a couple extremely delicious meals.

Court may limit use of race in college admission decisions

WASHINGTON (Reuters) - Thirty-five years after the Supreme Court set the terms for boosting college admissions of African Americans and other minorities, the court may be about to issue a ruling that could restrict universities' use of race in deciding who is awarded places.
The case before the justices was brought by Abigail Fisher, a white suburban Houston student who asserted she was wrongly rejected by the University of Texas at Austin while minority students with similar grades and test scores were admitted.
The ruling is the only one the court has yet to issue following oral arguments in cases heard in October and November, the opening months of the court's annual term which lasts until the early summer. A decision might come as early as Monday, before the start of a two-week recess.
As hard as it is to predict when a ruling will be announced, it is more difficult to say how it might change the law. Still, even a small move in the Texas case could mark the beginning of a new chapter limiting college administrators' discretion in using race in deciding on admissions.
For decades, dating back at least to the John F. Kennedy administration of the 1960s, U.S. leaders have struggled with what "affirmative action" should be taken to help blacks and other minorities. In the early years, it was seen as a way to remedy racial prejudice and discrimination; in the more modern era, as a way to bring diversity to campuses and workplaces.
Since 1978, the Supreme Court has been at the center of disputes over when universities may consider applicants' race. In that year's groundbreaking Bakke decision from a University of California medical school, the justices forbade quotas but said schools could weigh race with other factors.
In another seminal university case, the court in 2003 reaffirmed the use of race in admissions to create diversity in colleges. But with the current bench more conservative than the one in 2003, there is a strong chance a majority of the justices will undercut that decade-old ruling on a University of Michigan case.
Writing for the majority in that case, Grutter v. Bollinger, Justice Sandra Day O'Connor declared that "the path to leadership" should be "visibly open to talented and qualified individuals of every race and ethnicity." That meant public universities must be able to take special steps to enroll minorities, O'Connor wrote.
O'Connor retired in January 2006 and her successor as the regular swing vote on racial dilemmas has been Justice Anthony Kennedy, who dissented in the 2003 case and may well author the ruling to come in the latest case. The student in the case, Abigail Fisher, graduated from Louisiana State University last year.
"HURT," "INJURY"
Notably, during oral argument in the University of Texas case on October 10, Kennedy referred to the "hurt" and "injury" caused by screening applicants by race. However, Kennedy's comments during arguments suggested that he was not ready to vote to forbid all racial criteria in admissions.
In his dissenting opinion in the 2003 Michigan case, he wrote that the court has long accepted universities' stance that racial diversity enhances the educational experience for all students, while insisting such policies be narrowly drawn.
Kennedy's view of when exactly race can be considered and of the discretion of college administrators in the matter are likely to be crucial.
Marvin Krislov, now president of Oberlin College in Ohio and a past vice-president and general counsel of the University of Michigan, said on Friday that university administrators were concerned about how broadly it might sweep and whether it will ultimately reduce the number of minority students on campus.
"Colleges and universities care deeply about student body diversity," he said, adding of his colleagues in higher education: "We're all watching and waiting."
Once oral arguments are held, the court's deliberations on a case are shrouded in secrecy. The timing of a particular decision is not known in advance. And racial dilemmas have never been easy for the court, a point underscored by the current delay.
When the justices ruled in the 1978 case Regents of the University of California v. Bakke, they issued six separate opinions. None drew a majority. Four justices would have upheld a program that set aside a certain number of slots for minority applicants; four justices would have struck it down. Justice Lewis Powell provided the essential fifth vote, allowing universities to consider race and ethnic origin but forbidding quotas or a reserved number of places. Powell planted the seed of the diversity justification that blossomed in O'Connor's opinion in 2003.
The Michigan case divided the bench 5-4, with O'Connor joining with the more liberal members of the bench to allow race as a consideration in admissions. In a 2007 dispute testing the use of race in student placements to ensure diversity in school districts, the court tipped the opposite way. Conservatives, including O'Connor's successor Samuel Alito, curtailed such public school integration plans.
Only eight of the nine justices will be deciding the Texas case. Justice Elena Kagan, a former U.S. solicitor general, has taken herself out of the dispute because of her prior involvement in the case. The government is siding with the University of Texas.
The challenged program supplements a Texas state policy guaranteeing admission to the university for high school graduates scoring in the top 10 percent at their individual schools. University of Texas administrators argue that the "Top 10" program does not make the university sufficiently diverse.
The Texas approach, with the dual programs, is distinct. The larger issue is how a decision would affect other universities.
"The court seems to have been leaning away from allowing affirmative action for some time," said University of Virginia law professor John Jeffries, a former law clerk and biographer of Justice Lewis Powell. "If they close the door that, potentially, is a very big deal."

What a two weeks it’s been. Something happened that has been simmering for a while. The API market exploded. Intel bought Mashery for more than $180 million and CA acquired Layer 7. 3Scale received a new $4.5 million round of funding from Javelin Ventures. Programmable Web acquired Mulesoft. And then Facebook jumped in and bought Parse. The acquisitions and funding point to a maturing market that is reflected in the ubiquity of APIs across the application landscape. It’s not a new market by any means. The space is filled with companies that have leveraged the API build out that has happened over the past several years. Instead this is an inflection point. There are more than 30,000 APIs, according to Programmable Web, the leading API directory and blog. Javelin Ventures Managing Director Noah Doyle said to me in an interview that analysts see the API market growing five to ten times over the next five years. With that scaling in number of APIs comes a virtuous circle for the developers that build compelling apps and APIs. The APIs extend the apps reach as they become part of distributed data network. As more people use the APIs so the app developer generates more data. As the data increases in scope, often the service will become an API. Facebook needs new streams of data to keep rolling out new digital products. Back end as a service providers like Parse provide SDKs and APIs that give developers access to infrastructure for storing basic data types, locations and photos. How Facebook uses this data is a question mark. But regardless, Pare serves as a constant replenishing source, nourished by the apps on the Parse platform that use APIs. Facebook now will decide how to package and segment that data to push more relevant advertising to its 1 billion users. 6 months after Sandy, thousands homeless in NY, NJ
MANTOLOKING, N.J. (AP) ? The 9-year-old girl who got New Jersey's tough-guy governor to shed a tear as he comforted her after her home was destroyed is bummed because she now lives far from her best friend and has nowhere to hang her One Direction posters.
A New Jersey woman whose home was overtaken by mold still cries when she drives through the area. A New York City man whose home burned can't wait to build a new one.
Six months after Superstorm Sandy devastated the Jersey shore and New York City and pounded coastal areas of New England, the region is dealing with a slow and frustrating, yet often hopeful, recovery. Tens of thousands of people remain homeless. Housing, business, tourism and coastal protection all remain major issues with the summer vacation ? and hurricane ? seasons almost here again.
"Some families and some lives have come back together quickly and well, and some people are up and running almost as if nothing ever happened, and for them it's been fine," New York Gov. Andrew Cuomo said at a news conference Thursday. "Some people are still very much in the midst of recovery. You still have people in hotel rooms, you still have people doubled up, you still have people fighting with insurance companies, and for them it's been terrible and horrendous."
Lynda Fricchione's flood-damaged home in the Ortley Beach section of Toms River, N.J., is gutted; the roof was fixed just last week. The family is still largely living out of cardboard boxes in an apartment. But waiting for a final decision from federal and state authorities over new flood maps that govern the price of flood insurance is tormenting her and many others.
"The largest problem is, nobody really knows how high we're going to have to elevate the house," she said. "At town hall they told us 5 feet, but then they said it might go down to 3 feet in the summer. Most of us are waiting until the final maps come out. It's wait-and-see."
But more than anything, Fricchione is optimistic, buoyed by a recent trip to New Orleans with her daughter during which they met a resident of the Lower Ninth Ward who was one of the first to move back in after Hurricane Katrina inundated the neighborhood that has become a symbol of flood damage ? and resilience.
"Talking to that man was wonderful!" Fricchione said. "He said it takes time and you just have to have hope and know it will all work out eventually."
By many measures, the recovery from Superstorm Sandy, which struck Oct. 29, has been slow. From Maryland to New Hampshire, the National Hurricane Center attributes 72 deaths directly to Sandy and 87 others indirectly from causes such as hypothermia due to power outages, carbon monoxide poisoning and accidents during cleanup efforts, for a total of 159.
The roller coaster that plunged off a pier in Seaside Heights, N.J., is still in the ocean, although demolition plans are finally moving forward. Scores of homes that were destroyed in nearby Mantoloking still look as they did the day after the storm ? piles of rubble and kindling, with the occasional bathroom fixture or personal possession visible among the detritus.
Throughout the region, many businesses are still shuttered, and an already-tight rental market has become even more so because of the destruction of thousands of units and the crush of displaced storm victims looking to rent the ones that survived.
Homeowners are tortured by uncertainty over ever-changing rules on how high they'll need to rebuild their homes to protect against the next storm; insurance companies have not paid out all that many homeowners expected; and municipalities are borrowing tens of millions of dollars to keep the lights on, the fire trucks running and the police stations staffed, waiting for reimbursement from the federal government for storm expenditures they had to fund out of pocket.
And yet, by other measures, remarkable progress has been made. Boardwalks, the tourism lifeblood of the region, are springing back to life. A handful of homes are going up, and the whine of power saws and the thwack of hammers is everywhere in hard-hit beach towns as contractors fix what can be saved and bulldozers knock down what can't.
Volunteers in Highlands, N.J., are rebuilding the home of Bromlyn Link, the single mother of a 17-year-old boy, both of whom are members of the town's first aid squad and who spent 12 to 14 hours a day helping friends and neighbors forced to live in shelters for weeks after the storm.
Mantoloking, which was cut in half by the storm and saw all 521 of its homes damaged or destroyed, is creeping back to life. The post office recently, reopened, and the first of 50 demolitions will start next week, which is also when Mayor George Nebel will join the 40 other residents who have been able to move back home.
Beaches that were washed away are coming back, due both to nature and bulldozers, and real estate agents say demand for this strangest of upcoming summers appears good, particularly in the large portions of the Jersey shore that were relatively unscathed by Sandy. Beach badges, required for access to most of New Jersey's shoreline, are selling at a near-record pace in Belmar, N.J.
And while towns fortify beaches and dunes and put up sea walls, rock barriers or even sand-filled fabric tubes to guard against future storms, state governments are readying hundreds of millions of dollars to buy out homeowners in flood-prone areas who want to leave.
"We've made a lot of progress in six months; I know we still have a long way to go," New Jersey Gov. Chris Christie said at a recent town hall meeting. "By Memorial Day, every boardwalk that was destroyed at the Jersey shore will be rebuilt. Businesses are reopening. Rentals are picking up again, roads are back open."
Christie estimated 39,000 New Jersey families remain displaced, down from 161,000 the day after the storm. In New York, more than 250 families are still living in hotel rooms across New York paid for by the Federal Emergency Management Agency, while others are still shacking up with relatives or living in temporary rentals.
Everyone simply wants to make their homes livable again, said Ray Marten, whose home in the Belle Harbor section of New York City's Queens borough burned down when a fire swept along his street during the storm, and whose family of six is renting a nearby house.
"If you go up my block now, all the houses have been demolished and removed," Marten said. "They're pretty much just holes in the ground. Sand pits."
Separation is the new reality for the Gatti family, a clan of several generations that shared the same three-story home near the ocean on Staten Island until Sandy destroyed it. The flood-soaked place was demolished months ago, and they're waiting for a government buyout. Now the family is scattered across New Jersey, New York and Texas.
"The whole family's separated," said Marge Gatti, the matriarch. "And it's terrible, you know?"
Her son, Anthony, recently drove a U-Haul packed with his meager belongings to Killeen, Texas, where he will start a new life as a car mechanic.
"Mentally, I'm not all that well in the head," said Anthony Gatti, who slept in a tent in front of the ruined home for weeks after the storm. "I know I've got to get some kind of help. I can't seem to shake it out of my life."
Ginjer Doherty was 9 years old when Sandy bubbled up through the floor of her Middletown, N.J., home and ripped the front wall off it. She and her parents went to a firehouse a few days later to see Christie talk about what was being done to recover.
The governor comforted Ginjer, telling her she would be all right, that the grown-ups were on top of things and would take care of her. Ginjer recently had an essay published in Time magazine recalling the encounter and describing her life after Sandy.
"My house was all messed up, and people told us we couldn't stay there anymore," she wrote. "The governor told me not to worry ? that my parents would take care of everything ? and he looked very serious and sad, and he cried.
"Things are going O.K. for my family," she wrote. "We want to go back home, but rebuilding is going to take a long time. But we have a place to live for now. I even rescued a cat that was homeless after Sandy; I wanted him to be safe and loved like I feel."
In an interview with The Associated Press, Ginjer, now 10, said she is sad that her home won't be ready until October; her mom says it has been gutted and needs to be elevated.
Of the delay, Ginjer said simply, "It stinks."
Sandy also damaged interior areas, particularly those along rivers in northern New Jersey. Cities including Hoboken and Jersey City were inundated, and officials continue try seek exemptions for skyscrapers and large apartments from federal rules requiring flood-prone buildings to be elevated. George Stauble, whose Little Ferry house took in four feet of water, said FEMA payouts caused some rifts between neighbors.
"Everybody's house had pretty much the same amount of damage, but people are getting different amounts of money, and that's caused some problems," he said, adding some homeowners received as little as $8,000, while others received as much as $29,000.

T-Mobile quickly gives in to WA Attorney General, agrees 'UNcarrier' is misleading to consumers
Device financing terms to be clarified going forward; some customers can leave without penalty
T-Mobile has been making some big steps towards what it calls an "UNcarrier" strategy, which clarifies device pricing, ends phone contracts and gives customers more choice in the wireless industry. In trying to reinvent its strategy, however, T-Mobile has apparently ruffled some feathers at the Washington State Attorney General's office. Attorney General Bob Ferguson claims that T-Mobile's new plan structure is deceptive, leaves unfulfilled promises, and has "duped" consumers.
Ferguson specifically takes issue with the way T-Mobile now finances devices -- with a small down payment and monthly installments -- claiming that although the carrier claims there is no commitment to the service, customers will have to stay for 24 months or "face an unanticipated balloon payment for the phone equipment". Specifically, the AG had this to say:
“My office identified that T-Mobile was failing to disclose a critical component of their new plan to consumers, and we acted quickly to stop this practice and protect consumers across the country from harm.”
Ferguson has filed a court order, which has been signed and agreed upon by T-Mobile, that will force the carrier to clarify its terms of service and stop what Ferguson calls "deceptive advertising". Under the terms of the order, T-Mobile has created a document called the "an Assurance of Discontinuance (AOD)", better laying out the terms of the new Simple Choice plans. Inside, the carrier agrees not to:
- Misrepresent consumers' obligations under its contracts, including those contracts that have not restrictions or limitations; and
- Fail to adequately disclose that customers who terminate their T-Mobile wireless service before their device is paid off will have to pay the balance due on the phone at the time of cancelation.
As part of the settlement, anyone who purchased service from T-mobile from March 26 to April 25 will be given an opportunity to leave the service agreement, with no penalty, and receive a full refund for the device and service provided they cite the terms of the new AOD.
